Ricky Delk, who has been charged with attempted capital murder, appeared via video from New River Valley Regional Jail on Monday morning. The judge granted the defense attorney’s request for an evaluation on Delk’s competency and sanity. The incident happened in July when authorities say they responded to Delk’s home after his wife called police. The findings of the evaluation will be reviewed in Wythe County General District Court on Feb. 8.

At about 9:45 p.m. Tuesday, members of the Wythe County Sheriff’s Office and Virginia State Police responded after Delk’s wife called to alert them that he was armed after returning home from the Moose Lodge drunk, according to the warrant. She also told them that he had previously served in the military and was a former police officer who suffers from post traumatic stress syndrome. Delk and the two deputies were taken to Carilion Roanoke Memorial Hospital for treatment. Both Foster and Coleman have also been released from the hospital.

At about 12:30 p.m., Wythe County Sheriff Keith Dunagan told 10 News that this deputy is doing well and may be released Wednesday.
