ROCKY MOUNT, Va. – A former Rocky Mount Police Officer will continue serving time for storming the Capitol on January 6, 2021, after he lost his appeal.
Thomas Robertson claimed in his appeal the evidence presented during his trial was not enough to prove he acted “corruptly.”
Robertson was caught on camera inside the Capitol building holding a large stick, proving he used force to stop congressional proceedings.
Two out of the three-judge appeal panel concluded that since Robertson used force, he was wrong and, therefore corrupt.
A third judge sided with Robertson. They said there is too broad of an interpretation of the law and the word “corrupt.”
Robertson will continue serving his seven-year and three-month prison sentence.
