Schools can’t prevent transgender students from using the restrooms that correspond with their gender identities without violating federal law, the Obama administration says. The government’s filing says a Gloucester County School Board policy that requires Grimm to use either the girls’ restrooms or a unisex bathroom constitutes unlawful bias under Title IX, the 1972 law that prohibits sex discrimination in education. GLOUCESTER COUNTY, Va. (WAVY) — A Virginia transgender teenager made Time Magazine’s list of the 30 Most Influential Teens of 2016.

Time says 17-year-old Gavin Grimm has become a poster child for LGBT rights.

Grimm, who was born a female and identifies as male, has been barred from using the restroom that matches his gender identity at Gloucester High School by the school board.

The 4th U.S. Circuit Court of Appeals said the policy violates Title IX, a federal law that prohibits discrimination in schools. The board asked the high court in August to review this ruling.

The ACLU of Virginia filed a brief with the U.S. Supreme Court asking justices not to review the ruling.

The high court has not yet said whether or not it would review the case.
