Grimm, who was born a female and identifies as male, has been barred from using the restroom that matches his gender identity at Gloucester High School by the school board.

The 4th U.S. Circuit Court of Appeals said the policy violates Title IX, a federal law that prohibits discrimination in schools. The board asked the high court in August to review this ruling.

The ACLU of Virginia filed a brief with the U.S. Supreme Court asking justices not to review the ruling.

The high court has not yet said whether or not it would review the case.
