ROANOKE COUNTY (WSLS 10) - Roanoke County police say they had to use force to arrest a man they initially found passed out in his vehicle in a Wendy's drive-through lane.
Alvin Murdock, 34, of Roanoke, is charged with DUI (third or subsequent offense), obstructing justice and giving false identification to a law enforcement officer.
On Sunday, August 28, just before midnight, police responded to a call for service in Wendy's parking lot on Electric Road.
The caller said a man in the drive-through lane of the restaurant was passed out inside his vehicle, with the engine running and was unresponsive.
Roanoke County Fire & Rescue initially responded to the call because it appeared the man may have had a medical emergency.
Upon seeing the condition of the man, medics called for police to respond, according to a press release from Roanoke County.
Police say that after waking him and asking him to step out of the vehicle, it appeared to the officers that the man was under the influence of alcohol and/or some other substance.
He presented false identification to the officers.
While officers conducted field sobriety tests, they say Murdock ran away from them and went behind the Enterprise Rental Car building next door.

In a statement released to the public by local organizations including Southern Christian Leadership Council and Black Lives Matter, organizer said the cell-phone video shows Murdock "on the ground, handcuffed with his pants and underwear down to his ankles and the two officers kneeling on top of him and repeatedly punching down onto his body".

According to the press release from Roanoke County, officers pursued him and during the course of the incident, it was necessary for officers to use force to subdue Murdock and take him into custody.
Fire & Rescue personnel returned to the scene and transported him to the hospital where he received medical attention for minor injuries. He was then taken to Roanoke County Jail.
Per standard departmental policy, the Roanoke County Police Department is conducting a review of the use of force by police officers.
