Court documents show lawsuit against BAE following sexual assault

ROANOKE (WSLS 10) - Court documents show that a female plaintiff filed a lawsuit against BAE, a federal defense contractor that operates the Radford Army Ammunition Plant (the "Arsenal"). According to court documents, the suit is in relation to sex discrimination and harassment as assault and battery.

The plaintiff went to work at the Arsenal in March 2005, records show. The lawsuit states that the plaintiff was sexually harassed and sexually assaulted and battered by Joshua Linkous, a coworker. The documents, filed in the United States District Court for the Western District of Virginia Roanoke Division, state that on May 19, 2014, the plaintiff was leaving a building at work when Linkous came up behind the plaintiff and told her he needed to ask her something. As the plaintiff tried to walk away, Linkous grabbed the plaintiff's clothing and pulled her backward toward him, according to official documents.

The court records showed various incidents where the plaintiff discussed encounters with Linkous. In the claim against BAE, it states that "BAE knew or should have known of the hostile work environment and failed to take prompt remedial action reasonably calculated to end the harassment."
