Jessica Ewing files motion to appeal sentence

CHRISTIANSBURG (WSLS10) - In a handwritten note filed in February, Jessica Ewing called her 45-year sentence cruel and unusual punishment.

Ewing also claimed her first amendment right had been violated.

She argued a text message used as evidence in the case against her was taken out of context.

The former Virginia Tech student said there's reasonable doubt for the true meaning of the message.

The Commonwealth's Attorney said Ewing lost her ability to have the evidence against her dismissed when she entered an Alford Plea.

Ewing was charged with concealing a body and first degree murder of Virginia Tech student Samanata Shrestha in 2014.
