Hearing held in case of South Boston man who died in police custody

ROANOKE (WSLS 10) - A hearing was held Thursday in U.S. District Court involving a lawsuit of a South Boston man who died in police custody.

The man, Linwood Lambert, died in 2013.

Two year later Lambert's sister, Gwendolyn Smalls, is suing the town of South Boston and its police department for $25 million over the death of her brother.

According to documents and videos taken the day he died, Lambert was tasered multiple times while being taken to the hospital.

In court Thursday, lawyers representing South Boston and its police department wanted to remove some words involving the lawsuit. They wanted to take out comparisons of racial bias and the word "murder" saying based on an autopsy Lambert died over an acute cocaine overdose.

Smalls' lawyers spoke after the hearing. They said Smalls was still heartbroken after the tragic loss of her brother.

"She's in terrible shape this is a tragic tragic story to see your loved one like that on videotape is as bad as it gets,' says Tom Sweeney.

We reached out to the defendant's lawyers but did not get back with us.
