City council members voted on August 6th to remove the flag after a number of heated public hearings.

Members of the Heritage Preservation Association and several other groups and individuals say, the vote breaches a 1994 agreement they had with the city to display the flag at the museum.

The city recently adopted an ordinance that only allows the United States, the Commonwealth of Virginia, the City of Danville, and the POW/MIA flags to fly on city owned flag poles.

The lawsuit also claims the city damaged the pole when workers removed the flag last week.

The group wants the city to put the flag up permanently.
