Motion filed to preserve cell phone found on Noah Thomas' body

PULASKI (WSLS 10) - Ashley White's lawyer filed a motion asking the medical examiner's office to preserve evidence found on the body of White's son, who was found in a septic tank under the family's mobile home.

White faces second degree felony murder in the case of her son, Noah Thomas' death.

White's attorney, Kelsey Bulger, filed a motion asking the sheriff's office and the Commonwealth attorney to produce a mobile phone found with Noah Thomas' body.

However, the sheriff's office and the attorney's office said the phone is not in their possession. Furthermore, they said they have no knowledge of the phone's existence.

The two suggested reference to a mobile phone in the autopsy report could have been a typo or phrase from a previous report.

The motion states Dr. Amy Tharp, Assistant Chief Medical Examiner for the Western District confirmed a mobile phone was found during a conversation with Bulger in her office on June 24.

The motion also state the phone was recovered in a right pocket during Thomas' autopsy on March 27.

According to the motion, no efforts have been made by the sheriff's office or Commonwealth attorney to find out what's on the mobile phone.
